Supreme Center
Hosting shall provide its Services to You (Customer) under
the Terms and conditions of this Supreme Center Hosting-Customer
Agreement. The Agreement is intended to protect both
the integrity and liability of Supreme Center Hosting. and
the Customer. This Service Agreement will be enforced to ensure
the speed, power, performance, and reliability of our services.
Supreme Center Hosting reserves the right
to change the terms, conditions, and notices under
which the Supreme Center Hosting Services are offered. You
are responsible for regularly reviewing these terms and conditions.
Your registration with the Supreme Center Hosting Services
or your continued use of the Supreme Center Hosting Services
constitutes your agreement to all such terms, conditions,
and notices, and with all applicable laws and regulations.
You understand and agree that the Service is provided "AS-IS"
and that Supreme Center Hosting assumes no responsibility
for the timeliness, deletion, mis-delivery or failure to store
any Customer communications or personalization settings.
Please read these Terms and Conditions carefully. We
will not notify you before we terminate your account for violation
of these Terms and Conditions. If we terminate your account,
we may not reinstate it in our sole discretion.
LICENSE GRANT. Subject to the provisions contained
herein and payment of applicable fees, Supreme Center Hosting
hereby grants to you a non-exclusive, nontransferable, license
to use its accompanying proprietary software application products
offered on the Supreme Center Hosting web site for your own
use. Such Software is protected by the laws of the United
States and international treaties.
AGE VERIFICATION
Customer agrees that he/she is at least 18 years of age. If
the customer is not at least 18 years of age, a parent or
guardian's name must be put on the account and will be responsible
for payment and Web Site content. If a minor (a person under
the age of 18) obtains an account through Supreme Center Hosting
without parental approval, this agreement does not become
void.
Supreme Center Hosting is concerned about the safety and privacy
of all its Customers, particularly children under the age
of 13. Please remember that the Service is designed to appeal
to a broad audience. Accordingly, as the legal guardian, it
is parents' responsibility to determine whether any of the
Services and/or Content are appropriate for the child.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Supreme Center Hosting Services,
you will not use the Supreme Center Hosting Services for any
purpose that is unlawful or prohibited by these terms, conditions,
and notices. You may not attempt to gain unauthorized access
to any Supreme Center Hosting Services, other accounts, computer
systems or networks connected to any Supreme Center Hosting
Services, through hacking, password mining or any other means.
You may not obtain or attempt to obtain any materials or information
through any means not intentionally made available through
the Supreme Center Hosting Services.
Supreme Center Hosting reserves the right at all times to
disclose any information as Supreme Center Hosting deems necessary
to satisfy any applicable law, regulation, legal process or
governmental request, or to edit, refuse to post or to remove
any information or materials, in whole or in part, in Supreme
Center Hosting's sole discretion.
INDEMNIFICATION
Customer agrees to indemnify and hold Supreme Center Hosting
and its licensers, parents, subsidiaries, affiliates, network
partner sites, officers and employees, harmless from any claim
or demand, including reasonable attorneys' fees, made by any
third party due to or arising out of Customer's use of the
Supreme Center Hosting Service, the violation of the Agreement
by Customer, or the infringement by Customer, or by any other
user of the Supreme Center Hosting Service using Customer's
computer, of any intellectual property or other right of any
person or entity, or as a result of any threatening, libelous,
obscene, harassing or offensive material contained in any
user communications.
THIRD PARTY
Any dealings with third parties (including advertisers) included
within the Supreme Center Hosting Services or participation
in promotions, including the delivery of and the payment for
goods and services, and any other terms, conditions, warranties
or representations associated with such dealings or promotions,
are solely between you and the advertiser or other third party.
Supreme Center Hosting shall not be responsible or liable
for any part of any such dealings or promotions.
TERMINATION
You agree that Supreme Center Hosting, in its sole discretion,
may terminate your password, account (or any part thereof)
or use of the Service, and remove and discard any Content
within the Service if you violate these terms.
Refunds
You agree that Supreme Center Hosting will not refund the
cost of the hosting package, unless through error, the hosting
package you purchase is not the hosting package assigned to
you. To obtain a refund you must contact admin@Supreme Center
Hosting.com immediately after you receive access to the hosting
package.
RULES FOR USING THE Supreme Center Hosting SERVICES
!!!You are solely responsible for the content of your messages.
Using the Supreme Center Hosting Service in connection with
surveys, contests, pyramid schemes, chain letters, junk e-mail,
spamming or any duplicative or unsolicited messages (commercial
or otherwise) is prohibited!!!
YOUR RESPONSIBILITIES
In consideration of your use of the Service, you agree to:
1. Provide true, accurate, current and complete information
about yourself as prompted by the Service's registration form
2. Maintain and promptly inform us to update the Registration
Data to keep it true, accurate, current and complete. If you
provide any information that is untrue, inaccurate, not current
or incomplete, or Supreme Center Hosting has reasonable grounds
to suspect that such information is untrue, inaccurate, not
current or incomplete, Supreme Center Hosting has the right
to suspend or terminate your account and refuse any and all
current or future use of the Service (or any portion thereof).
3. You will receive a password and account designation
upon completing the Service's registration process. You are
responsible for maintaining the confidentiality of the password
and account, and are fully responsible for all activities
that occur under your password or account.
You agree to
- immediately notify Supreme Center Hosting of any unauthorized
use of your password or account or any other breach of security
- ensure that you exit from your account at the end of each
session.
Supreme Center Hosting cannot and will not be liable for any
loss or damage arising from your failure to comply with this
4. Any Customer in violation of system or network security
is subject to criminal and civil liability, as well as immediate
account termination. Examples include, but are not limited
to the following: Unauthorized access, use, probe, or scan
of a systems security or authentication measures, data or
traffic. Interference with service to any user, host or network
including, without limitation, e-mail bombing, flooding deliberate
attempts to overload a system and broadcast attacks. Forging
of any TCP/IP packet header or any part of the header information
in an e-mail or newsgroup posting.
15. Customer agrees not to publish on or over its account
any information, software or other content which violates
or infringes upon the rights of any others or which knowingly
contravenes the laws of any jurisdiction in which such content
is Genericly accessible.
5. Supreme Center Hosting does NOT allow sites that
provide any content, points of distribution, or 'links' to
sites that:
- infringe on any third party's intellectual property or proprietary
rights, or rights of publicity or privacy;
- violate any law, statute, ordinance or regulation;
- are defamatory, trade libelous, threatening, unlawfully
harassing, abusive, pornographic or obscene;
- any topic, name, material or information that incites discrimination,
hate or violence towards one person or a group because of
their belonging to a race, a religion or a nation, or that
insults the victims of crimes against humanity by contesting
the existence of those crimes;
- contain viruses, Trojan horses, worms, time bombs, cancelbots,
corrupted files, or any other similar software or programs
that may damage the operation of another's computer or property
of another;
- contain Pirated Software (Warez) - Any software that is
copyrighted and not freely available for distribution without
cost. ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) all
fall under this jurisdiction;
- contain Hacking / Phreaking - Includes sites with material,
links, or resources for Hacking, Phreaking, Viruses, Anarchy,
or any type of site that promotes the destruction or compromises
the integrity of the Service;
- contain any other similar software, programs or other content
which violates or infringes upon the rights of any others
or which knowingly contravenes the laws of any jurisdiction
in which such content is Genericly accessible;
- has Adult Sites (content) - Any erotic or pornographic material,
links to adult sites, or advertisements for adult sites.
6. You agree not to transfer accounts for gain or otherwise.
Transfer of such accounts will result in termination of contract
with end Customer.
SPAMMING IS PROHIBITED
We will determine in our sole discretion whether any of the
messages you send are spam. For your information, spamming
Genericly includes, but is not limited to:
- the bulksending of unsolicited messages, or the sending
of unsolicited e-mail which provoke complaints from recipients
- the sending of junk mail
- the use of distribution lists that include people who have
not given specific permission to be included in such distribution
process
- posting commercial ads to USENET newsgroups that do not
permit it
- posting articles containing binary encoded data to a non-binary
newsgroups
- excessive and repeated posting off-topic messages to newsgroups
- excessive and repeated cross-posting
- e-mail harassment of another Internet Customer or Customers,
including but not limited to, transmitting any threatening,
libelous or obscene material, or material of any nature which
could be deemed to be offensive
- the e-mailing of age- inappropriate communications or content
to anyone under the age of 18.
COPYRIGHTS
Copyrighted material must not be placed on Customer's account
without the permission of the owner(s) or person(s) they specifically
authorize. Only the owner(s) or such authorized person(s)
may upload copyrighted material to the account.
Supreme Center Hosting respects the intellectual property
of others, and we ask our Customers to do the same. If you
believe that your work has been copied in a way that constitutes
copyright infringement, or your intellectual property rights
have been otherwise violated, please provide Supreme Center
Hosting's Postmaster ( webmaster@Supreme Center Hosting.com
) the following information:
- an electronic or physical signature of the person authorized
to act on behalf of the owner of the copyright or other intellectual
property interest;
- a description of the copyrighted work or other intellectual
property that you claim has been infringed;
- a description of where the material that you claim is infringing
is located on the site;
- your address, telephone number, and email address;
- a statement by you that you have a good faith belief that
the disputed use is not authorized by the copyright owner,
its agent, or the law;
- a statement by you, made under penalty of perjury, that
the above information in your Notice is accurate and that
you are the copyright or intellectual property owner or authorized
to act on the copyright or intellectual property owner's behalf.
Upon our receipt of notice of a claimed copyright infringement
containing the above information, after confirmation we will
promptly remove the allegedly infringing material from the
Services and carry out further procedures if necessary. We
will have no liability to any Customer of the Services for
the removal of any such material.
DISCLAIMER OF WARRANTY:
Supreme Center Hosting EXPRESSLY DISCLAIMS ANY WARRANTY FOR
ITS SERVICE. THE Supreme Center Hosting SERVICE IS PROVIDED
ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION,
THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, OR NON-INFRINGEMENT. THE ENTIRE RISK AS TO THE PERFORMANCE
OF, OR ARISING OUT OF THE USE OF THE Supreme Center Hosting
SERVICE IS BORNE BY CUSTOMER. Supreme Center Hosting MAKES
NO WARRANTY REGARDING ANY GOODS, INFORMATION OR SERVICES PURCHASED
OR OBTAINED THROUGH THE USE OF THE Supreme Center Hosting
SERVICE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL
PART OF THE AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS
OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO
CUSTOMER AND CUSTOMER MAY HAVE OTHER LEGAL RIGHTS THAT VARY
BY JURISDICTION.
LIMITATION OF LIABILITY:
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT,
OR OTHERWISE, SHALL Supreme Center Hosting OR ITS LICENSERS
OR RESELLERS BE LIABLE TO CUSTOMER OR ANY OTHER PERSON FOR
ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING
FROM THE USE OF OR THE INABILITY TO USE THE Supreme Center
Hosting SERVICE, THE PERFORMANCE OF Supreme Center Hosting
SERVICE, OR DAMAGES FOR LOSS OF GOODWILL, BUSINESS PROFIT,
BUSINESS STOPPAGE, LOSS OF DATA OR BUSINESS INFORMATION, COMPUTER
DAMAGE, OR DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR
CHANGES MADE TO CUSTOMER'S TRANSMISSIONS OR DATA, OR ANY AND
ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL Supreme
Center Hosting BE LIABLE FOR ANY DAMAGES IN EXCESS OF WHAT
Supreme Center Hosting RECEIVED FROM CUSTOMER FOR THE Supreme
Center Hosting SERVICE. SOME STATES DO NOT ALLOW THE EXCLUSION
OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS
LIMITATION AND EXCLUSION MAY NOT APPLY TO CUSTOMER.
PRIVACY POLICY
PRIVACY OF YOUR ACCOUNT. We consider your registration
data and the content of all of your messages to be private.
Messages that you send will be received with your name and
Internet Protocol (IP) address contained within the header
of your message. We will not intentionally monitor or disclose
any of your e-mail messages or registration data unless we
believe in good faith that we are required to do so
- to enforce these Terms and Conditions,
- by law,
- to defend us in any action,
- to protect our property.
Additionally, you agree to respect the privacy and confidentiality
of others. Since privacy is a function of your password, we
encourage you to change your password frequently and to not
share it with anyone.
PRIVACY OF YOUR REGISTRATION DATA. Supreme Center
Hosting collects information during the registration process.
The personally identifiable information Supreme Center Hosting
collects includes first and last name. In addition, Supreme
Center Hosting also collects non-personally identifiable information
such as: country, age, gender, etc. You may update your Registration
Information at any time from the members area.
You understand that we may disclose statistics about our aggregate
registration information in connection with our marketing
activities.
WHY DO WE NEED THIS INFORMATION. Your registration
information is used to operate the site, for demographic statistics,
for supporting your account, etc. Supreme Center Hosting will
not send you any unsolicited information, including e-mail,
except as mentioned below. New Customers will receive a Supreme
Center Hosting welcome letter explaining the features provided
by the service. Supreme Center Hosting may also send periodic
member letters to announce important service changes, new
features, technical issue updates and news about the Service.
Supreme Center Hosting keeps your personally identifiable
information private and does not share it with any third parties.
Supreme Center Hosting
Title, ownership rights, and intellectual property rights
in all content and material that is part of, contained in,
or accessed through the Supreme Center Hosting Service, and
provided by either Supreme Center Hosting or sponsors or any
other content provider shall remain the sole property of Supreme
Center Hosting and/or its sponsors or any other content provider.
Customer acknowledges and agrees that certain college, university,
team, celebrity or business names contained within Supreme
Center Hosting e-mail addresses may represent protected trademarks
and service marks. Such content and materials are protected
by the copyrights, trademark, service mark and patent laws
and treaties.
These Terms and Conditions will be governed by and
construed in accordance with the international and native
laws without giving effect to principles of conflict of laws.
If any provision of this Agreement is held to be invalid or
unenforceable, such provision shall be struck and the remaining
provisions shall be enforced. Our failure to act with respect
to your breach does not waive our right to act with respect
to subsequent or similar breaches. These Terms and Conditions
set forth the entire understanding and agreement between you
and us.
U.S. GOVERNMENT RESTRICTED RIGHTS. Use, duplication
or disclosure by the Government is subject to restrictions
set forth in subparagraphs (a) through (d) of the Commercial
Computer-Restricted Rights clause at FAR 52.227-19 when applicable,
or in subparagraph (c)(l)(ii) of the Rights in Technical Data
and Computer Software clause at DFARS 252.227-7013, and in
similar clauses in the NASA FAR Supplement. Contractor / manufacturer
